2. Schedule of Fees and Charges
Under the California Deferred Deposit Transaction Law, the maximum fee that may be charged is 15% of the face amount of the check. The following table shows the fees, total repayment amounts, and the corresponding Annual Percentage Rates (APR) for common loan amounts and terms:

Maximum face amount of any deferred deposit transaction is $300. The maximum net amount a borrower can receive is $255 (after the $45 fee on a $300 check). APR is calculated as: (Fee ÷ Loan Amount) × (365 ÷ Term in Days) × 100.
Important: The Annual Percentage Rate (APR) shown reflects the cost of the loan as an annualized rate. Payday loans are designed to be short-term financial solutions (up to 31 days) and are not intended for long-term borrowing. The high APR reflects the short-term nature of the loan and should not be compared to APRs for longer-term credit products such as credit cards, auto loans, or mortgages.
3. Borrower Rights Notice
Pursuant to California Financial Code §23035, you have the following rights as a payday loan borrower in California:
Your Rights Under California Law
- No Criminal Prosecution: You cannot be criminally prosecuted or threatened with criminal prosecution for a deferred deposit transaction (payday loan). A returned check from a payday loan transaction is not subject to criminal prosecution under California Penal Code §476a.
- No Collateral Required: No licensee may require or accept any collateral, other than the borrower’s personal check, in connection with a deferred deposit transaction.
- Right to Rescind (Cancel): You have the right to cancel your payday loan without any cost by returning the full amount of the loan to the lender by the close of the next business day following the date of the transaction.
- Right to an Extended Payment Plan: If you are unable to repay your loan on the due date, you may request an extended payment plan at no additional charge. You are entitled to one extended payment plan per 12-month period. The extended payment plan allows you to repay the loan in at least four substantially equal installments over a period of time at least as long as the original loan term, with no additional fees or charges.
- No Rollovers: Rollovers are prohibited under California law. A licensee may not make a new deferred deposit transaction to a customer on the same business day that another deferred deposit transaction between the licensee and that customer has been completed or paid. You cannot be required to take out a new loan to repay an existing loan.
- Civil Code §1719 Exemption: A deferred deposit transaction under Financial Code §23035 is not subject to the treble damages provision of Civil Code §1719 (which applies to bad checks in other contexts).
- Maximum Loan Limits: The maximum face amount of any single deferred deposit transaction is $300. The maximum fee is 15% of the face amount of the check ($45 on a $300 check). The maximum loan term is 31 days.
4. Federal Compliance Disclosures
Truth in Lending Act (TILA) — Regulation Z
Before you sign a loan agreement, Cash in Flash will provide you with a Truth in Lending disclosure that includes the Annual Percentage Rate (APR), the finance charge (fee), the amount financed, and the total of payments. These disclosures allow you to compare the cost of our loan with the cost of credit from other sources.
Equal Credit Opportunity Act (ECOA) — Regulation B
Cash in Flash does not discriminate on the basis of race, color, religion, national origin, sex, marital status, age, receipt of public assistance income, or the good-faith exercise of any right under the Consumer Credit Protection Act. If your application for credit is denied, you have the right to a written statement of the specific reasons for the denial. To obtain the statement, please contact us at (747) 270-7121 within 60 days from the date you are notified of our decision.
Fair Credit Reporting Act (FCRA)
Cash in Flash may obtain information from non-traditional consumer reporting agencies when evaluating your loan application. This inquiry may affect your overall credit profile with the applicable reporting agency but will not impact your FICO® Score. If information from a consumer report is used in whole or in part to make an adverse decision regarding your application, you will be provided with the name and contact information of the consumer reporting agency that supplied the report. You have the right to dispute the accuracy or completeness of information in your consumer report directly with the reporting agency.
Electronic Fund Transfer Act (EFTA) — Regulation E
If your loan repayment involves an electronic fund transfer (such as an ACH debit from your bank account), Cash in Flash will obtain your authorization before initiating any electronic transfer. You have the right to:
- Receive documentation of electronic transfers
- Stop payment on a preauthorized electronic fund transfer by notifying your financial institution at least three business days before the scheduled date of the transfer
- Report errors or unauthorized transfers within 60 days of receiving a statement showing the error
Servicemembers Civil Relief Act (SCRA) & Military Lending Act (MLA)
Notice to Active Duty Military and Dependents: Federal law provides important protections to active duty members of the Armed Forces and their dependents. Under the Military Lending Act (MLA), the maximum allowable Military Annual Percentage Rate (MAPR) for covered loans to active duty servicemembers and their dependents is 36%. Payday loans to covered borrowers may be subject to additional restrictions. If you are an active duty servicemember or the spouse or dependent of an active duty servicemember, please inform us so we can ensure compliance with applicable military lending protections. Payday loans (deferred deposit transactions) are designed for short-term financial needs only and are not intended as a long-term financial solution. Customers with credit difficulties should seek credit counseling before entering into any loan transaction. All loans are subject to approval pursuant to standard underwriting criteria. Not all applicants will qualify for a loan or for the maximum loan amount. Submitting an application does not guarantee approval.
